When the police/prosecution are considering if a person should be convicted for driving under the influence of drugs or if drug/alcohol use is offered as a defence, several questions will be raised:
- Did alcohol or drugs contribute to the behaviour of the individual at the time of the incident?
- Was the individual impaired by the effects of alcohol and/or drugs at the time of the incident?
- What are the effects of the drug detected?
- Was the individual drunk at the time of the incident?
- Could the individual have developed tolerance to the effects of the drug detected/alcohol?
- Was the individual a drug addict/alcoholic?
